FML I Got Rearended Today!!

Well i got rear ended today on 580 in livermore in between vasco rd and first street!! i got hit by a 1997 nissan pathfinder. it was stop and go traffic and i was just sitting there and next thing you know i hear tires sliding and next thing bam. hella bad whip lash. hit my head on my roll bar. and my back hurts hella bad. so we pull over on the side of the road and the first thing i said is please tell me you have insurance and he said ya. so i told him that we should go to a gas station so we can swap info.. so we did.. so he says that he looked at a pot hole and then looked up and slammed on the breaks!! so ya im going to figure out what the hell is going to happen!!!

battle scarred car... I feel you bro... Problem with my situation is that it was my cousin who backed into my car while it was parked.... No insurance claim and he payed for new corner lense but no body work.... I know a guy in tracy who does body work, has a shop on eleventh street

so my uncle talked to the guy and gave him 3
choices either 1 he buys it. 2 he pays for the body shop to fix it!!(i
have to go get a quote today) or 3 have his insurance deal with it!!

thanks man.. well i call his insurance and they need to get ahold of him to talk to him so we shall see what happens *crosses fingers*

okay so i finally talked the other guys insurance people and they said
that it is his fault. and i told them i have a back pain and neck pain
so the lady said that she will send me a 500 dollhair check. and gave me
a body shop number to call and have my car check out. so i went and the
guy who did the inspection was really nice. $2700 for the repairs. but i
think my car will end up being totaled and i have to wait for some one
to call me back or something. so what about all the aftermarket stuff
such as rim's rollbar and body kit? does any of that come in to play or
anything?!?!

dont settle yet the longe u wait the more money u get. are they gonna pay for your medical?

lol it didn't cost me anything to go get seen or anything.. and so if i wait longer i get more money how?

cause u want more money thats why. my boy was in a car accident couple years back and they offer him 500 up front but he didnt settle so he waited and settle for 1200. and tell them your sunglass broke and produce a receipt and show to them so thay can pay for it

If you neck and back really does hurt..
the 500 dollar check isn't going to cover it in the long run.

as for your car,

what they are going to do is see how much your car is really worth using whatever auto pricing program they have. If the worth of the car is lower than the repairs, they will more likely just total it and pay you for the amount of what they think it's worth. 99% of the time, it's not what you want. SO what you do is tell them( if the price theyg ive you is too low) that you can't accept it because you can't buy another car for that price. Then you can tell them that you can help them look for current ads of the car with all the same features and options and see what they're prices are going for sale. You obviously want to show cars that cost more than yours just so you can say your car is worth more than what they say.

Best case, they give you what you ask for your car...other than that, just hope they at least meet you half way.

The process will take a long time ( took me over a month to get my shirt sorted) but in the end, it's better to get close to what you want than just to settle.

okay well i just got a phone call form mercury insurance group and they said my car is a total loss and that they will pay me out 2187.81 dollhairs and that is with me keeping the car so i told him that did he get any of my aftermarket stuff like my full body kit and my rims and my rollbar and he said no and i said well you should include those in to the price and they said okay what is the brand of this stuff so i can look it up and see what i can do for you.. and ya. so hopefully they will boost the price a little bit.
